{"id":4342,"date":"2025-08-14T23:16:37","date_gmt":"2025-08-14T21:16:37","guid":{"rendered":"https:\/\/drtopuzidu.hu\/uncategorized\/hasznos-tudnivalok-a-gyermektartasdijrol-i-resz\/"},"modified":"2025-10-08T21:36:52","modified_gmt":"2025-10-08T19:36:52","slug":"useful-information-on-child-support-part-i","status":"publish","type":"post","link":"https:\/\/drtopuzidu.hu\/en\/legal-blog\/useful-information-on-child-support-part-i\/","title":{"rendered":"Useful Information on Child Support \u2013 Part I"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In this blog post, we examine how parental responsibilities for child support are determined when the parents are no longer living together, what the Civil Code (Ptk.) provides regarding the maintenance of a minor child, and what factors the court considers when determining child support.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-is-parental-responsibility-for-child-support-determined-when-the-parents-are-no-longer-living-together\">How is parental responsibility for child support determined when the parents are no longer living together?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The joint responsibility of parents to support their child becomes particularly relevant when the parents live separately. In such cases, one parent typically provides support in kind by directly caring for the child, while the other pays child support in monetary form. (V\u00e9k\u00e1s\u2013G\u00e1rdos, 2014, p. 866)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-does-the-civil-code-say-about-the-maintenance-of-a-minor-child\">What does the Civil Code say about the maintenance of a minor child?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under the chapter of the <a href=\"https:\/\/net.jogtar.hu\/jogszabaly?docid=a1300005.tv\">Civil Cod<\/a>e governing the general rules on maintenance obligations between relatives, a separate section is devoted to the maintenance of a minor child, which contains special rules applicable to minors compared to the general provisions on maintenance. (V\u00e9k\u00e1s\u2013G\u00e1rdos, 2014, p. 866)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 4:194 (1) of the Civil Code sets out the basic criteria for entitlement to maintenance: a person is entitled to maintenance from their relatives if they are unable to provide for themselves through no fault of their own, and if they have no spouse, former spouse, or domestic partner who is legally obliged to support them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The above general rule applicable to maintenance between relatives applies differently in the case of a minor child. (V\u00e9k\u00e1s\u2013G\u00e1rdos, 2014, p. 866)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By virtue of their age, a minor is generally unable to support themselves and typically lacks the financial means necessary for subsistence. Therefore, in the vast majority of cases, minors are dependent on their parents for support. [Dr. K\u0151r\u00f6s A. (2007): \u201cFontolva halad\u00e1s\u201d \u2013 az \u00faj Ptk. Csal\u00e1djogi K\u00f6nyve 9. R\u00e9sz: A gyermektart\u00e1s. CSJ, 2007\/2, p. 2] The Civil Code establishes a presumption that a minor child is in need of support. This presumption also applies to a child in secondary school until the age of 20. The presumption can be rebutted, for example, by taking into account the child\u2019s own earnings or income, if such income is of such an extent that the child is able to fully or partially support themselves.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A parent cannot be relieved of the obligation to pay child support on the grounds that doing so would endanger their own necessary subsistence. According to the Civil Code, a parent is obliged to support a minor child even at the cost of restricting their own necessary subsistence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With regard to the form of child support, the Civil Code stipulates that the parent who cares for the child provides support in kind, while the parent living separately fulfils their obligation primarily in monetary form (child support payments). The obligation to support a minor child takes precedence over the obligation to support any other entitled person, including adult children.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Code allows the parents to agree on the amount of child support. If the parents of a minor child who live separately cannot reach an agreement, the court must determine the amount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The method and amount of child support are governed by the general rules on maintenance. Accordingly, the court determines the amount based on the justified needs of the recipient and the payer\u2019s ability to pay, with the understanding that the maintenance of a descendant also covers the costs of upbringing and necessary education. (<a href=\"https:\/\/kuria-birosag.hu\/sites\/default\/files\/joggyak\/joggyak._osszefoglalo_2018_dr._makai_katalin.pdf\">Makai et al., 2018, p. 10<\/a>)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-factors-does-the-court-consider-when-determining-child-support\">What factors does the court consider when determining child support?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Code specifies the factors the court must examine when determining child support. In addition to the justified needs of the child, the court must first and foremost examine the income and financial circumstances of both parents. According to legal commentary, the child\u2019s justified needs cannot be equated with a bare minimum standard of living; rather, they must ensure an average standard of living tailored to the child\u2019s individual needs.
